Jury finds defendant not guilty of second-degree DWI Test Refusal
Eric’s client was charged with second-degree DWI test refusal and third degree driving while impaired. After the prosecutor was unwilling to dismiss the charges, Eric successfully obtained a not guilty verdict after a jury trial. During the trial, Eric argued that the police had misidentified his client and failed to conduct an adequate investigation. Eric demonstrated reasonable doubt by cross-examining the police officers about their poor investigation and presenting strong supporting evidence that his client was innocent. After deliberation, the jury sided with Eric and his client and returned two verdicts of not guilty.
Reduced 110-month sentence to 36 months
Eric’s client was charged with third-degree burglary and theft and agreed, while represented by another lawyer, to be sentenced as a career criminal to 110 months. After an appeal, Eric took the case over and successfully argued that the State lacked evidence to sentence him as a career criminal. Eric opposed any other sentencing enhancement, and the prosecution agreed to sentence his client to 36 months. Although his client had sat in jail while his matter was pending, he had accrued enough time for a 36-month sentence and was released a week after the hearing.
Defended against potential embezzlement charges
Eric’s client unknowingly passed embezzled money and was caught in an investigation and possible legal action. Eric successfully defended the matter by getting a confession and full repayment from a third party, and negotiating the dismissal of all potential legal action.
12-month sentence reduction for Felony DWI.
Eric’s client was charged with, and plead guilty to, a felony DWI. However, Eric focused on his client’s mitigating factors and negotiated a 12-month reduction of a presumptive sentence, which was under the presumptive sentence for his client’s offense and criminal history.
Fugitive from justice charge dismissed
Eric’s client was charged with being a fugitive from justice and was faced with extradition to another state. Eric successfully argued that his client should be allowed to travel of his own free will and ultimately got the fugitive from justice charge dismissed.
Driving without insurance — dismissed
Eric’s client failed to pay her insurance dues for a month and got into a car accident. She faced stiff penalties, including a loss of his driver’s license, for driving without insurance. However, Eric worked with the prosecutor and got the driving without insurance charge dismissed and his client ended up paying a small fine.
